By using the Site you agree to these terms. If you do not agree, please do not use the Site. Our Privacy Policy and Cookie Notice explain how we handle personal data and cookies.
2. Changes to the Site and these terms
We may update, change, suspend or withdraw the Site, or any part of it, at any time and without notice. We may also revise these terms. The version published on this page when you use the Site is the one that applies, so please check it from time to time.
3. Intellectual property
We own, or are licensed to use, all intellectual property rights in the Site and its content, including text, graphics, logos, the nChain name and marks, images and software. All such rights are reserved.
You may view the Site and print or download extracts for your own personal, non-commercial reference. You must not:
- modify any material you print or download;
- use any images, graphics or other media separately from the text that accompanies them;
- remove any copyright or other proprietary notice; or
- use any part of the Site’s content for commercial purposes without a licence from us or our licensors. You can request a licence at [email protected].
Nothing on the Site grants you any licence to any nChain patent, patent application, trade mark or other intellectual property right, except as expressly stated.
4. Acceptable use
You may use the Site only for lawful purposes. You must not:
- use the Site in any way that breaches applicable law or regulation, or that is fraudulent or harmful;
- introduce viruses, malware or any other harmful material;
- attempt to gain unauthorised access to the Site, the servers or networks it runs on, or any connected system;
- attack the Site with a denial-of-service attack or similar;
- scrape, harvest or bulk-collect content or data from the Site by automated means beyond ordinary search-engine indexing;
- use the contact form to send spam, unsolicited advertising or unlawful content, or to submit someone else’s personal data without authority.
We may report breaches to the relevant authorities. If you breach this section, your right to use the Site ends immediately.
5. Linking to the Site
You may link to the Site’s home page, provided you do so fairly and lawfully and in a way that does not damage our reputation or take advantage of it. You must not:
- suggest any association, approval or endorsement by us where none exists;
- frame the Site on another site; or
- link from any website that contains unlawful, offensive or misleading content.
We may withdraw this permission at any time.
6. Third-party links
Where the Site links to other websites or resources provided by third parties, the links are for your information only. We have no control over those sites and accept no responsibility for their content, availability or privacy practices. A link does not mean we endorse the linked site.
7. No warranty; information only
The content of the Site is provided for general information only. It is not legal, financial, investment or technical advice, and you should not rely on it as such. We make reasonable efforts to keep the Site up to date, but we provide it “as is” and “as available”. To the extent permitted by law, we make no representation or warranty, express or implied, that:
- the content is accurate, complete or current;
- the Site will be available, uninterrupted or error-free; or
- the Site is free of viruses or other harmful components.
You are responsible for using your own virus protection.
8. Limitation of liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and for intent or gross negligence where Swiss law does not allow it to be excluded.
Subject to that, and to the fullest extent permitted by law, we are not liable to you for any loss or damage arising from your use of, or inability to use, the Site, or from your reliance on any of its content. This applies whether the claim is in contract, tort (including negligence), breach of statutory duty or otherwise. It covers in particular:
- loss of profits, revenue, business, contracts, goodwill or anticipated savings;
- loss or corruption of data; and
- any indirect or consequential loss.
If you are a consumer, nothing in these terms affects your statutory rights.
9. Contact form
When you use the contact form, you confirm that the information you give is accurate and that you are entitled to provide it. Sending a message does not create any contract or obligation for either party. We aim to reply to genuine enquiries but cannot guarantee a response. How we handle the data you submit is described in our Privacy Policy.
10. General
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions stay in effect. If we do not enforce any of these terms, that does not mean we have waived our right to do so later.
11. Governing law and jurisdiction
These terms, their subject matter and their formation, and any non-contractual disputes or claims arising from them, are governed by the laws of Switzerland. The courts of Switzerland have exclusive jurisdiction. This does not deprive consumers of any mandatory protection, or any right to bring proceedings, that they have under the law of the country where they live.
